Why warehouse dilapidations need specialist expertise
Large industrial units typically carry substantial repair, reinstatement, and redecoration obligations. But the figure on a landlord's schedule is rarely the amount a tenant actually has to pay. Knowing the difference and being able to evidence it is where claims are won or lost.
Two disciplines, one fee
One of the points we make most often is the value of combining building surveying with valuation advice:
- A Building Surveyor assesses the repair obligations and the scope of works.
- A Valuation Surveyor considers how any disrepair actually affects the property's value.
That distinction matters because Section 18 of the Landlord and Tenant Act caps a landlord's damages for disrepair at the diminution in the value. This means, however high the cost of works on a schedule, the landlord cannot recover more than the actual loss in value to the property. Where the cost of works exceeds that figure, the diminution cap can significantly reduce, or even extinguish, the claim.
This is why valuation evidence sits alongside surveying evidence in any well-defended dilapidations claim.
